1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Levered ("Levered", "we", "us", or "our"), an individual developer based in the United Kingdom, governing your access to and use of the Levered mobile application (Arabic: رَكيزة) ("the App"), available on Apple's App Store.

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not download, install, or use the App.

We reserve the right to update or modify these Terms at any time. Changes become effective upon posting the revised Terms with an updated "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the revised Terms. If you do not agree to any revised Terms, you must stop using the App and uninstall it.

2. Definitions

  • "App" means the Levered iOS application, including all its features, content, updates, and associated services.
  • "Content" means all text, images, graphics, audio, code, designs, and materials provided within or through the App.
  • "User Content" means all data, text, and entries you create within the App, including thought records, mood entries, exercise logs, and notes.
  • "AI Features" means the premium artificial intelligence-powered features, including but not limited to distortion detection, smart reframes, evidence helper, daily tips, and exercise recommendations.
  • "Premium Subscription" or "Levered Premium" means the paid auto-renewable subscription that unlocks AI Features and additional exercises.
  • "Free Tier" means the core features available at no cost, without a subscription.

3. Description of Service

Levered is a self-help mental health companion application built on Cognitive Behavioural Therapy (CBT) principles. The App provides tools for structured thought recording, mood tracking, guided breathing exercises, therapeutic exercises, and journaling. Optional Premium features include AI-powered analysis and suggestions.

The App is available in English and Arabic and requires iOS 18.0 or later.

4. Medical and Mental Health Disclaimer

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS IMPORTANT LIMITATIONS ON THE NATURE OF THE APP.

Levered is NOT a medical device, medical application, or health care service. The App does NOT provide medical advice, psychiatric or psychological diagnosis, clinical treatment, therapy, counselling, or any form of professional mental health care.

The App is designed exclusively as a self-help and self-reflection tool intended to complement — not replace, substitute for, or serve as an alternative to — professional mental health care, therapy, counselling, or medical treatment. The CBT-based tools, exercises, and techniques within the App are for informational and educational purposes only.

Specifically, you acknowledge and agree that:

  • The App is not a substitute for professional diagnosis or treatment of any mental health condition, including but not limited to depression, anxiety, PTSD, bipolar disorder, or any other psychological or psychiatric disorder.
  • No therapist-patient, doctor-patient, counsellor-client, or any other professional relationship is created between you and Levered, its developer, or any entity associated with the App.
  • The App should not be used as the sole basis for making mental health decisions. Always seek the advice of a qualified mental health professional for any questions regarding a mental health condition.
  • AI-generated content (including distortion detection, reframes, evidence suggestions, tips, and recommendations) is produced by automated systems and may be inaccurate, incomplete, inappropriate, or inapplicable to your specific circumstances. AI output should never be treated as professional advice.
  • The breathing exercises within the App are not medical interventions. If you have any respiratory, cardiovascular, or other medical condition, consult your physician before using breathing exercises.
  • The cognitive distortion classifications, descriptions, and examples within the App are simplified educational summaries and are not diagnostic criteria.

IN CASE OF A MENTAL HEALTH EMERGENCY OR CRISIS: If you are experiencing suicidal thoughts, self-harm urges, or a mental health crisis, please immediately contact emergency services (999 in the UK, 911 in the US, or your local emergency number), go to your nearest emergency department, or contact a crisis helpline such as:

5. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher) to use the App. By using the App, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you should review these Terms with a parent or legal guardian before using the App. Your parent or guardian is responsible for supervising your use of the App.

The App is not directed at, marketed to, or intended for use by children under 13. We do not knowingly collect personal data from children under 13 (see our Privacy Policy for details).

6. User Accounts

Levered does not require, support, or maintain user accounts. No registration, email, password, or personal information is needed to download or use the App. Your data is stored locally on your device (with optional iCloud sync managed by Apple).

7. Subscription Terms

7.1 Free Tier

The following core features are available for free with no time limitations, usage restrictions, or feature degradation:

  • 5-step thought records (unlimited)
  • Mood tracking and streak analytics
  • 7 guided breathing techniques with audio
  • 2 therapeutic exercises (Grounding and Gratitude)
  • Journal timeline with search and filters
  • Progress charts and distortion analytics
  • iCloud sync across Apple devices
  • Home screen mood check-in widget
  • Dark mode and bilingual support (English/Arabic)

7.2 Levered Premium

Premium features require an active Levered Premium subscription and include:

  • AI-powered cognitive distortion detection
  • AI-powered smart reframes
  • AI-powered evidence helper
  • Personalised daily tips and exercise recommendations
  • Full 10-exercise therapeutic toolkit (8 additional exercises)

7.3 Pricing and Billing

  • Price: $3.99 USD per month (or equivalent in your local currency as determined by Apple).
  • Product ID: help.levered.premium.monthly
  • Payment: Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-renewal: The subscription automatically renews each month unless cancelled at least 24 hours before the end of the current billing period.
  • Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
  • Free trial: If a free trial is offered, the unused portion of any free trial period will be forfeited when you purchase a subscription.

7.4 Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time through:

  • iOS Settings > [Your Name] > Subscriptions
  • The App Store > [Your Profile] > Subscriptions

Cancellation takes effect at the end of the current billing cycle. You will retain access to Premium features until the end of your paid period. No refunds are provided for the unused portion of a subscription period, except as required by applicable law or Apple's refund policies.

7.5 Price Changes

We reserve the right to change subscription pricing at any time. Price changes will be communicated through the App Store in accordance with Apple's policies. Any price increase will not affect your current billing period; you will be notified and given the opportunity to cancel before the new price takes effect.

7.6 Apple's Role

All subscription and payment processing is managed by Apple through StoreKit 2 in accordance with the Apple Media Services Terms and Conditions. Levered does not collect, process, or store any payment information. For billing inquiries, disputes, or refund requests, please contact Apple Support directly.

8. AI Features and Limitations

8.1 Consent Requirement

AI Features require your explicit, informed, and affirmative consent before they are activated. You will be presented with a clear explanation of what data is sent and how it is processed before you can opt in. AI Features are never enabled by default. You may revoke consent at any time in the App's Settings, which immediately stops all AI data transmission.

8.2 Data Processing

When AI Features are active, the text you are currently working on (thought, situation, distortion selections, mood value, and language preference) is sent to our API for real-time processing. This data is processed transiently and is not stored, logged, or used for model training. For full details, see our Privacy Policy.

8.3 Accuracy Disclaimer

AI-generated suggestions, pattern detections, reframes, evidence prompts, daily tips, and exercise recommendations are provided for self-reflection and educational purposes only. You acknowledge and agree that:

  • AI output may be inaccurate, incomplete, misleading, or inappropriate for your specific situation.
  • AI output is not professional advice of any kind (medical, psychological, legal, or otherwise).
  • AI distortion detection may produce false positives (identifying distortions that are not present) or false negatives (missing distortions that are present).
  • AI-generated reframes may not accurately reflect your circumstances and should be treated as starting points for self-reflection, not as definitive conclusions.
  • You should always exercise your own independent judgment when evaluating AI output.
  • Levered makes no representations or warranties regarding the accuracy, completeness, reliability, or suitability of AI output.

8.4 Crisis Detection Limitations

The AI service includes automated crisis detection that attempts to identify content suggesting self-harm or suicidal ideation. When such content is detected, the App surfaces crisis helpline resources and support information. You acknowledge and agree that:

  • Crisis detection is an automated safety measure, not a substitute for professional crisis intervention, emergency response, or mental health assessment.
  • Crisis detection may fail to identify genuine crises (false negatives) or may incorrectly flag non-crisis content (false positives).
  • Crisis detection does not contact emergency services, mental health professionals, or any third party on your behalf.
  • You should never rely solely on the App's crisis detection in a mental health emergency. Always contact emergency services or a crisis helpline directly.
  • Levered assumes no responsibility or liability for the performance, accuracy, or reliability of crisis detection.

8.5 Rate Limiting

AI Features are rate-limited to 60 requests per day per device. This limit may be adjusted at our discretion. Exceeding the rate limit will result in temporary inability to access AI Features until the limit resets.

9. User Content

All User Content you create within the App (thought records, mood entries, exercise logs, notes, and reflections) remains your sole property. We do not access, own, licence, or claim any rights to your User Content.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. You acknowledge that your User Content is stored on your device (and optionally in your iCloud account) and that we have no ability to access, recover, or restore it.

10. Intellectual Property

All Content, including but not limited to the App's source code, object code, design, user interface, graphics, icons, images, audio files, text, documentation, trade names, trademarks, and service marks, is owned by or licenced to Levered and is protected by applicable copyright, trademark, patent, and other intellectual property laws of the United Kingdom and international treaties.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App on Apple devices that you own or control, in accordance with Apple's Usage Rules set forth in the Apple Media Services Terms and Conditions.

This licence does not grant you any right to:

  • Copy, modify, adapt, translate, or create derivative works of any part of the App
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except to the extent expressly permitted by applicable law
  • Distribute, sell, lease, rent, lend, sublicence, or otherwise transfer the App or any rights therein to any third party
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the App's name, logo, or branding for any purpose without our prior written consent

11. Prohibited Uses

You agree not to:

  • Use the App for any unlawful, fraudulent, or malicious purpose
  • Attempt to reverse engineer, decompile, disassemble, or extract the App's source code, except as expressly permitted by applicable law
  • Circumvent, disable, or otherwise interfere with any security features, subscription restrictions, or access controls
  • Use automated systems, scripts, bots, or other means to access the AI Features beyond normal individual use
  • Attempt to overwhelm, abuse, or exploit the AI service or API infrastructure
  • Misrepresent the App as providing professional medical, psychological, psychiatric, or therapeutic advice
  • Use the App in any manner that could damage, disable, overburden, or impair the App or its services
  • Interfere with or disrupt the integrity or performance of the App or any third-party services it relies upon
  • Use the App to generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Share, distribute, or publicly display AI-generated output in a manner that misrepresents it as professional advice

12. Third-Party Services

The App relies on the following third-party services, each governed by their own terms and policies:

  • Apple iCloud (CloudKit): For optional cross-device data synchronisation. Governed by Apple's iCloud Terms of Service and Apple's Privacy Policy.
  • Apple App Store (StoreKit 2): For subscription management and payment processing. Governed by the Apple Media Services Terms and Conditions.
  • Cloudflare Workers: Infrastructure for AI feature processing. Governed by Cloudflare's Terms of Service.

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

13. Apple Licensed Application End User Licence Agreement

You acknowledge and agree that these Terms are between you and Levered only, and not with Apple Inc. ("Apple"). However, you also acknowledge the following with respect to Apple's involvement:

  • Licence scope: The licence granted to you for the App is limited to a non-transferable licence to use the App on Apple-branded products that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  • Maintenance and support: Levered is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
  • Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Product claims: Levered, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Levered, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
  • Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
  • Compliance with laws: You represent and warrant that: (a) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We expressly disclaim all implied warranties, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of any content or AI output
  • Uninterrupted, error-free, or secure operation
  • That the App will meet your requirements or expectations
  • That defects will be corrected
  • That the App is free of viruses or other harmful components

No advice or information, whether oral or written, obtained from Levered or through the App shall create any warranty not expressly stated in these Terms.

Without limiting the foregoing, we make no warranty that:

  • AI-generated distortion detections, reframes, evidence suggestions, tips, or recommendations will be accurate, helpful, or appropriate for your situation
  • Breathing exercises will produce any particular physiological or psychological effect
  • The App's crisis detection feature will correctly identify all instances of crisis content or refrain from false detections
  • Use of the App will result in any improvement in your mental health or wellbeing
  • iCloud sync will function without interruption, delay, or data loss

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions shall apply to the maximum extent permitted by applicable law.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

15.1 IN NO EVENT SHALL LEVERED, ITS DEVELOPER, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, whether stored on-device, in iCloud, or otherwise
  • Emotional distress, psychological harm, or deterioration of mental health
  • Personal injury or wrongful death arising from your use of the App or reliance on its content
  • Reliance on AI-generated output, distortion detections, reframes, or recommendations
  • Failure of the crisis detection feature to identify or correctly respond to crisis content
  • Delay or failure in seeking professional mental health care due to use of the App
  • Loss of profits, revenue, business, or anticipated savings
  • Loss of goodwill or reputation
  • Cost of procurement of substitute services
  • Any other damages of any nature, whether arising in contract, tort (including negligence), strict liability, or otherwise

even if Levered has been advised of the possibility of such damages.

15.2 IN NO EVENT SHALL LEVERED'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO LEVERED FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY POUNDS STERLING (£50 GBP).

15.3 THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF LEVERED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

15.4 Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the laws of England and Wales.

16. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Levered, its developer, and its affiliates, licensors, and service providers from and against any and all claims, actions, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or relating to:

  • Your use of or inability to use the App
  • Your violation of these Terms
  • Your violation of any applicable law, rule, or regulation
  • Your violation of any third-party right, including any intellectual property, privacy, or proprietary right
  • Any content you submit, post, or transmit through the App
  • Any claim that your use of the App caused damage to a third party
  • Your reliance on AI-generated content, distortion detections, reframes, or recommendations
  • Your failure to seek appropriate professional mental health care

This indemnification obligation shall survive termination of these Terms and your use of the App.

17. Termination

By you: You may terminate your use of the App at any time by uninstalling the App from your device and cancelling any active subscription through the App Store.

By us: We reserve the right to terminate or suspend your access to Premium features, the AI service, or the App as a whole, without prior notice and without liability, if:

  • You violate these Terms
  • You engage in fraudulent activity, including subscription fraud
  • You abuse, exploit, or attempt to circumvent the AI service or API
  • You use automated systems to access the AI Features beyond normal individual use
  • We are required to do so by law, regulation, or court order
  • We discontinue the App or any of its features

Effect of termination: Upon termination, your right to use the App ceases. However, all User Content stored on your device remains yours. Sections of these Terms that by their nature should survive termination (including Sections 4, 10, 14, 15, 16, and 22) shall survive.

18. Force Majeure

Levered shall not be liable for any failure to perform or delay in performing any obligation under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, epidemics, or pandemics
  • War, terrorism, civil unrest, or government actions
  • Failure of telecommunications, internet service, or hosting infrastructure (including Apple and Cloudflare outages)
  • Power outages or equipment failures
  • Changes in applicable law or regulation
  • Labour disputes, strikes, or shortages
  • Cyberattacks, including DDoS attacks, hacking, or malware

The affected obligation shall be suspended for the duration of the force majeure event, and performance shall resume once the event ceases.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

Subject to Section 20, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination.

Nothing in these Terms shall affect any mandatory consumer protection rights you may have under the laws of your country of residence that cannot be waived by contract.

20. Dispute Resolution

20.1 Informal Resolution: Before initiating any formal proceedings, you agree to first contact us at contact@levered.help and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly and to your satisfaction through direct communication.

20.2 Formal Proceedings: If the dispute is not resolved informally within 30 days, either party may pursue formal legal proceedings in the courts of England and Wales, subject to any mandatory consumer protection laws that may apply in your jurisdiction.

20.3 Class Action Waiver: To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section shall be null and void.

21. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your data. The Privacy Policy is incorporated into these Terms by reference. By agreeing to these Terms, you also agree to our Privacy Policy.

22. General Provisions

22.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Levered regarding the use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the App.

22.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

22.3 Waiver

No failure or delay by Levered in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. A waiver of any right or provision shall be effective only if it is in writing and signed by Levered.

22.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations under these Terms without restriction and without notice to you. Any purported assignment in violation of this section is null and void.

22.5 No Third-Party Beneficiaries

Except for Apple and Apple's subsidiaries (as set forth in Section 13), these Terms do not confer any rights, remedies, or benefits on any third party.

22.6 Notices

All notices under these Terms should be sent to contact@levered.help. Because we do not collect user contact information, notices to you will be provided through the App, the App Store listing, or this website.

22.7 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

22.8 Language

These Terms are drafted in the English language. If there is any conflict between the English version and any translation, the English version shall prevail.
